I. The collection of location data

Applicable EU laws and guidance require that explicit consent of the user should be sought to collect and process his or her location data (i.e., the user’s position in terms of latitude and longitude) using a GPS device.

Under EU guidance, “Apps that require access to geolocation must use the location services of the OS [Operating System]”.

Therefore, user consent may be obtained via the operating system (OS) of the user device – in this case Android or iOS – asking the user's permission to allow the app to access his or her location for example via a dialogue box.

The location service cannot be switched on until the user has given consent – during installation or prior to accessing the geolocation.

Moreover, “it essential that the device continuously warns that geolocation is ‘ON’, for example through a permanently visible icon”.

Users should also be given the possibility to deactivate the geolocation service at any time.

Consequently, Wiser’s REM app should use the OS location features to collect and manage users' permission to geolocation. Wiser must ensure that settings are in place to obtain the user's permission to access his or her geolocation before using the app.

II. First layers of information: the Privacy Notice and Cookie Notice

II.I Privacy Notice

On the first page or screen where personal data are requested from the user (such as the sign-up page), the following privacy notice should be displayed:

("we", "us", "our") is the controller of the personal data you have entered above, as well as of any personal data that you will enter or that will be generated when using our app. We will process your personal data to enable you to sign in, to log in, and to use all features and services offered by our app. You have a right of access, rectification, erasure, restriction of processing, object to processing and data portability. Where personal data is requested from the user, he or she must be clearly informed whether the fields are optional (such as the phone number) or required (e.g. via an asterisk).

II.II Cookie Notice (only on the web-based app)

Since the web version of the REM app uses the Google Analytics SDK for audience measurement and statistical purposes, it is necessary to obtain user's prior consent. The SDK must not be activated before obtaining the user's effective and explicit consent via a popin or a cookie banner. You will find below a sample consent form.

Users should also be given the possibility to withdraw their consent to Google Analytics SDK at any time directly on the app (e.g., through a “cookie settings”, or “cookie icon”). Consent must be renewed regularly – 6 months is considered as a “good practice” in France.

We use cookies to analyse our traffic and the performance of this app using Google Analytics.

III. Second layer of information: the full Privacy Policy

This privacy policy should be permanently and easily accessible to the user in the app settings. Feel free to adapt the parts that would not be accurate or to supplement them as needed.

1. Our App

Wiser Solutions, Inc. (“Wiser”, “we”, “our”, “us”) respects your privacy and is committed to protecting your Personal Data and being transparent about how we collect, use, and process your Personal Data. This privacy policy applies to your use of the Wiser Retail Execution Management app (the “App”).

For the purpose of this privacy policy, Wiser is the data controller of the Personal Data processed by our App.

Our App allows our corporate customers to collect and analyse in-store data – which are not personal data – to automate processes and improve business performance.

However, accessing and using the App requires some Personal Data that may identify the end user (“User”, "you", "your", "yours").

This privacy policy helps you to understand what information we collect from you, when you use the App and how we use that information. This privacy policy also describes the choices available to you regarding collection, use, and access to your Personal Data.

2. Personal Data We Collect From You

We collect data, including Personal Data that you provide to us when signing up / signing in or when you interact with us or use the App.

"Personal Data" (as defined by applicable privacy laws such as the General Data Protection Regulation or “GDPR”) includes information that can be used to identify you as a natural person, directly or indirectly.

For the purpose of this policy, such Personal Data includes:

  • First and last name;
  • Email address;
  • Phone;
  • User profile photo;
  • User device information i.e. Model, Operating System, App Version;
  • Location information (latitude, longitude) using the GPS device;
  • Password;
  • Browsing and usage data when you use the web-based App;

Please note that actions and interactions performed in the App, which may generate usage data and result in reporting, are deemed attributed to the User who performed those actions and interactions.

3. Use Your Personal Data

We only collect, use and store your Personal Data for the purposes of operating the App and our services.

More specifically, the App allows you and/or our corporate customers to:

  • obtain retail data and other specific non-personal data (e.g., inventory levels) to improve sales opportunities;
  • access customer relationship management data for each store, such as delivery schedules or products on sale, or customer satisfaction surveys;
  • use our dashboard to support the workload of staff;
  • get automated reports;
  • notify any incident or technical issue on the App. Therefore, we will request Personal Data to identify you as necessary to address such incident or issue.
  • sign up and sign in.

We may also process Personal Data to:

  • improve the effectiveness and quality of service that our customers can expect from us;
  • help you with any enquiries and to provide you with positive user experience;
  • control or improve the security of the App.

We process your Personal Data to the extent necessary to perform our contractual duties with our corporate customers and in particular regarding the provision of the App. Therefore, we have a legitimate interest in processing your Personal Data in accordance with this privacy policy. We ensure that the processing of your Personal Data entails no risk to your interests, rights and freedoms.

We rely on your consent to use your location data, or to collect browsing or usage data via cookies or other tracking devices

Our corporate customers are independent data controllers for the data processing they carry out. Our customers and Users are fully responsible for their use of the App. Wiser takes no responsibility whatsoever for privacy practices of our corporate customers; we therefore encourage you to review their privacy policy.

4. Sharing Your Personal Data

The information we collect about you will be transferred to and stored on our servers located in the United States of America.

We share your Personal Data with Wiser’s subsidiaries for limited purposes (such as invoicing and contract management) and third-party service providers that provide services on our behalf. The types of third-party service providers with whom we share your Personal Data notably include IT service providers such as cloud/hosting provider and web analytics provider.

To the extent that the United States of America have not been lawfully recognised as providing an adequate level of data protection by the European Commission, we will ensure that the Personal Data that are processed by us and our suppliers outside of the European Economic Area (EEA) or the United Kingdom (UK) are adequately protected pursuant to applicable privacy laws. We ensure to use an appropriate data transfer safeguard(s), such as approved Standard Contractual Clauses.

Please contact us for further information on the specific mechanism used by us when transferring your Personal Data outside the EEA or the UK.

5. Security and Confidentiality of your Personal Data

The security and confidentiality of your Personal Data is important to us.

We take appropriate technical and organisational measures to protect Personal Data from accidental or unauthorized access, loss, use or disclosure and ensures that all collected information is stored in a controlled, secure environment, protected from unauthorized or accidental loss, access or disclosure.

These measures have been decided taking into account the level of risk, the nature of the data processed and the purposes of the processing.

The Internet and any transmission thereon cannot be guaranteed to be secure at all times, and we cannot ensure or warrant the security of any Personal Data you provide us through the App. In this regard, we have procedures to deal with any Personal Data breach in accordance with applicable laws.

To avoid any security problem, you must keep your login and password confidential and not disclose them to third parties.

6. Retention of Personal Data

We will retain your Personal Data for only as long as needed to fulfil the purposes for which they are collected, and in any case for the duration of the contractual relationship with our customers. After that, your Personal Data will be deleted forthwith. We may retain and use your Personal Data as necessary to comply with our legal, accounting or tax obligations, resolve disputes, protect our assets and enforce agreements to which Wiser is a party.

7. Your Rights

Under certain circumstances, depending on applicable laws and feasibility, you have the right to:

  • Request access to your Personal Data. This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.
  • Request correction of the Personal Data that we hold about you, when they are incomplete or inaccurate – although it does not apply to some data such as usage data.
  • Request erasure of your Personal Data (the “right to be forgotten”). This enables you to ask us to delete or remove your Personal Data provided that we no longer need to process them.
  • Object to processing of your Personal Data, on grounds relating to your particular situation.
  • Request the restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of Personal Data about you if, for example, you want us to establish its accuracy or the reason for processing it.
  • Request the transfer of your Personal Data to another party (“data portability”), where the data processing has been implemented (i) further to (a) your consent or (b) a contract with us and (ii) through automated means. Please note that such a request could be limited to the sole Personal Data you provided us with or that we hold at that given time.
  • Withdraw consent at any time, where we rely on consent to use your Personal Data.

We will promptly engage with you when you place such a request. Please note that we may not fully comply with your request, to the extent permitted by applicable laws, or if it would adversely affect the rights and freedoms of others or if it would be prohibited by law.

If necessary, we reserve the right to verify your identity before any request relating to your Personal Data processed by us.

If you are not satisfied with our answer or the way we process your Personal Data pursuant to this privacy policy, you may also have the right to lodge a complaint with a data protection authority. 8. Updates to this Privacy Policy

We reserve the right to update this privacy policy from time to time in order to reflect any changes to our App or to comply with changes in our legal and/or regulatory obligations.
